This document establishes the General Contracting Conditions of the website https://coach-gustavomarcos.com, which aims to purchase executive coaching sessions from Gustavo Marcos Cancelas (hereinafter, Gustavo Marcos Executive Coaching), with NIF 35303026G and whos registered office is at Rúa Lisboa 20B 5ºD, 15707, Santiago de Compostela by those natural or legal persons (hereinafter, contracting person or user) who express their willingness to acquire the products that are made available to them in the store on the website https://coach-gustavomarcos.com through the request made by electronic means, specifically, via the internet through that website owned by Gustavo Marcos Executive Coaching.
1. Contract information and documentation. Contract acceptance
These General Contracting Conditions are permanently displayed on the website https://coach-gustavomarcos.com, owned by Gustavo Marcos Executive Coaching, and all users can file, print and therefore be previously informed of the conditions under which the contracting of the store products (hereinafter, the product).
Likewise, these General Conditions are reiterated together with a summary of the specific request - specific product/s contracted/s, cost with indication of taxes if applicable, shipping costs, etc. - for their express acceptance of the contracting person, by clicking on "I have read and accept the terms and conditions", each time a specific request is made through the website.
It is not technically possible that the contracting person can finalize the request without the acceptance of these General Conditions. In order for the contracting person to be able to make this acceptance and, therefore, make the request, they must provide their data when ordering at https://coach-gustavomarcos.com, at which time they accept these Conditions and the Website's Privacy Policy.
The contracting person, by accepting these Conditions, gives his/hers express and unreserved consent for Gustavo Marcos Executive Coaching to carry out the collection operations necessary for the acquisition of the product that he/she hires, expressly authorizing Gustavo Marcos Executive Coaching to make the collections in the payment methods that he/she has selected, or entered from the secure area enabled for this purpose, in accordance with the regulations on payment services.
The present General Conditions together with the specific request made through the Internet by the contracting person - also called “Particular Conditions” - configure the content of the contract between Gustavo Marcos Executive Coaching and the contracting person who declares to have sufficient capacity to contract and have read, understood and accepted these conditions.
Gustavo Marcos Executive Coaching, at the time of contracting and within a period not exceeding twenty-four hours, will send the confirmation of the order placed to the email address associated with the contracting person's account.
The contracting person will permanently have these General Conditions on the website. Any subsequent modification of these General Conditions will be clearly displayed in an easily accessible place on the website https://coach-gustavomarcos.com. All the aforementioned documentation may be printed and filed by the contracting person, and may be requested at any time from the Customer Service Department, via email sent to info@coach-gustavomarcos.com.
Any request for information, or a claim that is deemed pertinent, may be submitted to the Customer Service at the address identified in the previous paragraph. The Service will acknowledge receipt of the claim submitted by forwarding the relevant supporting document - with the corresponding identification key - to the email address that must be provided to the Customer Service to process the claim.
2. Purpose
By this contract, Gustavo Marcos Executive Coaching undertakes to deliver to the contracting person the product that they have requested through the website https://coach-gustavomarcos.com in exchange for a certain price and in accordance with the conditions established in this document.
3. Rights and obligations of Gustavo Marcos Executive Coaching
Gustavo Marcos Executive Coaching will in no case be responsible for:
- Errors, delays in access by the contracting person when entering their details on the order form, the slowness or impossibility of confirming the order or any anomaly that may arise when these incidents are due to problems in the Internet network, fortuitous events or force majeure and any other unforeseeable contingency beyond the good faith of Gustavo Marcos Executive Coaching. In any case, Gustavo Marcos Executive Coaching undertakes to solve any problems that may arise and to offer all the necessary support to the contracting person in order to reach a rapid and satisfactory solution to the incident.
- Errors or damage caused by inefficient and bad faith use of the product by the contracting person.
- The inoperability of the e-mail address provided by the contracting person for the sending of the order confirmation.
4. Rights and obligations of the contracting person
4.1. Payment
The contracting person agrees to pay the amount for the product actually requested in the amount and manner established in these Conditions.

In the event of an error in the price of the product ordered by the contracting person, Gustavo Marcos Executive Coaching will inform him/her as soon as possible and will give him/her the option of reconfirming the order at the correct price or cancelling it. In the event that the contracting person cannot be contacted, the order will be considered cancelled and the amounts paid will be refunded in full, without the right to any compensation whatsoever.
The full final price shall include: taxes or fees, the amount of any increases or discounts applicable to the offer and any additional costs - for example, those associated with means of payment, etc. - that are passed on to the contracting person, which shall be expressly accepted by the contracting person.
Gustavo Marcos Executive Coaching shall issue the invoice corresponding to the contracted product, detailing all the items included in the invoice. The contracting person expressly consents to the invoice being sent electronically to the e-mail address provided when processing the order. At any time, the contracting person may communicate their wish to receive the invoices in paper format, by means of a communication addressed to the Customer Service Department.
4.1.2. Payment methods
The contracting person must pay the amount corresponding to the contracted product by any of the payment methods and procedures available on the website Gustavo Marcos Executive Coaching only accepts payments made by Paypal or card payment.
The Gustavo Marcos Executive Coaching website complies with the standards linked to SSL protocols. This ensures a secure and private transaction, guaranteeing the customer that Gustavo Marcos Executive Coaching can not access or store any data provided by the customer when making payment by virtual POS payment.

4.2. Withdrawal

The contracting of products that are made according to the specifications of the contracting person and are clearly personalised shall not be subject to withdrawal.
In order to exercise the right of withdrawal, the contracting person must notify his/her decision to withdraw from the contract by means of an unequivocal declaration to: Gustavo Marcos Executive Coaching, at Rúa Lisboa 20B 5ºD, 15707, Santiago de Compostela, or info@coach-gustavomarcos.com, indicating that he/she withdraws from the contract and providing the following data: order reference, date of receipt, name and surname of the contracting person and his/her address. You may also use the model form provided for in the current regulations on the defence of consumers and users. If the cancellation is presented on paper, it must be duly signed by the contracting person. In order to comply with the deadline, it is sufficient for the notification to be sent before the deadline expires.
In case of withdrawal by the contracting person, Gustavo Marcos Executive Coaching will refund all payments received, including, where appropriate, delivery costs (except for the additional costs resulting from the choice by the contracting person of a mode of delivery other than the least expensive mode of ordinary delivery offered by Gustavo Marcos Executive Coaching), without undue delay. Such reimbursement shall be made using the same means of payment used for the initial transaction, unless otherwise expressly agreed. The contracting person shall not incur any costs as a result of the reimbursement. Gustavo Marcos Executive Coaching may withhold reimbursement until the goods have been received or proof of return of the goods has been provided.
The contracting person shall return or deliver the products directly to Gustavo Marcos Executive Coaching, at Rúa Lisboa 20B 5ºD, 15707, Santiago de Compostela, without undue delay and in any event not later than fourteen calendar days from the date on which it communicates its decision to withdraw from the contract. The deadline shall be deemed to have been met if the goods are returned before the deadline has expired. The contracting person must bear the direct cost of returning the products. The cost of the return will depend on the transport and/or courier company selected by the contracting person to return the product.
4.3. Responsibility of the contracting person
The contracting person assumes all risks of deterioration, impairment, damage and loss of the product from the moment it has been made available to him by the third party who, on behalf of Gustavo Marcos Executive Coaching, delivers the requested product.
The contracting person will be responsible for the decrease in value of the products resulting from handling other than that necessary to establish the nature, characteristics and, where appropriate, the operation of the products.
The contracting person agrees to check the good condition of the product before the third party who, on Gustavo Marcos Executive Coaching behalf, delivers the requested product, a check that will be carried out prior to signing the proof of delivery.
5. Resolution
Gustavo Marcos Executive Coaching and the contracting person may terminate this contract for any of the causes established in the laws and in particular for the breach of these General Conditions. The termination of the contract may be exercised by contacting the other party at: the postal address provided by the contracting person when contracting the service, and at the Gustavo Marcos Executive Coaching address, duly identifying the contract to be resolved.
6. Copyright and trademark
Gustavo Marcos Executive Coaching informs that the own contents, programming and design of the website https://coach-gustavomarcos.com, are fully protected by copyright, all reproduction, communication, distribution and transformation of the aforementioned protected elements being expressly prohibited except with the express consent from Gustavo Marcos Executive Coaching.
Gustavo Marcos Executive Coaching may use external sources for the elaboration of its contents on certain occasions and / or establish links or hyperlinks to articles or information from third parties, always citing the source. The legitimate owner of the copyright of this information thus included may request at any time the removal of said references.

8. Jurisdiction and applicable law
These general conditions are governed by Spanish law. The Courts of Santiago de Compostela are competent to resolve any controversy or conflict arising from these general conditions, the contracting person expressly renouncing any other jurisdiction that may correspond to him. 9. Others
In the event that any clause of this document is declared null, the other clauses will remain in force and will be interpreted taking into account the will of the parties and the purpose of these conditions. This contract is made only in Spanish. Gustavo Marcos Executive Coaching may not exercise any of the rights and faculties conferred in this document, which will not imply in any case the waiver thereof unless expressly acknowledged by Gustavo Marcos Executive Coaching.
